Important: Read these Terms before using ADAR. By creating an account, purchasing a product, connecting an integration or otherwise using the service, you agree to these Terms and the adar.asia Privacy Policy.
1. Agreement to these Terms
These ADAR Terms of Service (“Terms”) are a binding agreement between you and Adar Digital Sdn. Bhd. They apply to the ADAR website at adar.asia, the ADAR web application and related products and services.
If you use ADAR for an organisation, you confirm that you have authority to bind that organisation, and “you” includes the organisation. If you do not agree to these Terms, do not use ADAR.
2. Service provider
ADAR is created and managed by Adar Digital Sdn. Bhd. (Company No. 1432692-A), Malaysia. References to “ADAR”, “we”, “us” and “our” mean Adar Digital Sdn. Bhd., unless a product page or transaction identifies another supplier for a particular item or service.
3. Eligibility and authority
You must have legal capacity to enter this agreement. If you are below the age at which you may form a binding contract, a parent or legal guardian must create or authorise the account, agree to these Terms and supervise your use.
You may use organisation, school or business features only if authorised by that organisation. You are responsible for ensuring that information you place in ADAR is collected and used lawfully.
4. Accounts and security
- Provide accurate, current and complete registration and billing information.
- Keep login credentials confidential and do not share an account except through supported team or role features.
- Notify us promptly of suspected unauthorised access or security incidents.
- You are responsible for activity conducted through your account unless caused by ADAR’s breach of its obligations.
We may require verification, password reset or other security steps before restoring access or processing sensitive requests.
5. ADAR services
ADAR provides web-based digital products and tools that may include exam preparation, learning games and game creation, business operations, product and sales knowledge, campaign and social-publishing workflows, customer leads, quotations, invoices, payment links, delivery coordination, reporting, point-of-sale, marketplace or station features.
Specific functions, access periods, prices and usage limits are described on the relevant product, subscription or checkout page. We may improve, add, replace or discontinue features. Where a material change affects a paid current service, we will use reasonable efforts to provide notice or an appropriate remedy required by law.
6. Education products and exam disclaimer
Exams Simplify and other education tools provide independent practice, feedback and learning support. Unless expressly stated, ADAR is not affiliated with, endorsed by or acting for any examination board, school, ministry or awarding body. Exam and organisation names may be used only to identify the learning pathway for which practice is designed.
ADAR does not provide official examination papers, leaked questions or a guarantee of any grade, admission outcome or academic result. Practice, automated marking and AI-assisted feedback may contain errors and should be reviewed by the learner, parent or educator. Users remain responsible for official registration, syllabus confirmation and examination requirements.
7. Corporate Services and business decisions
Corporate Services helps authorised users organise business information and workflows. Drafts, recommendations, calculations, reports and AI-assisted output are tools for review and are not legal, tax, accounting, financial, employment or other professional advice.
You are responsible for reviewing business content before publishing or relying on it, securing required permissions, maintaining source records and complying with laws and platform rules that apply to your organisation.
8. Prices, payments and subscriptions
- Prices and currency are displayed before checkout and may include applicable taxes where stated.
- Payments are processed by the gateway shown at checkout. The provider’s terms may also apply.
- You confirm that you are authorised to use the selected payment method.
- Access begins after ADAR receives a valid payment confirmation, unless a product states otherwise.
- A fixed access period ends automatically unless the checkout clearly states that it renews. Any recurring plan will disclose its interval and cancellation method before purchase.
- ADAR may correct obvious pricing or product-description errors before fulfilment and will provide an appropriate refund if payment cannot lawfully be fulfilled.
9. Cancellation, refunds and service issues
Cancellation and refund rights are governed by applicable law and the ADAR Refund, Return and Exchange Policy. Digital access that has already started may be non-refundable except where required by law, the product is materially defective, or ADAR agrees otherwise.
If you believe access was not delivered or a payment was duplicated, contact us promptly with the transaction reference. Do not send full card details.
10. Acceptable use
You must not use ADAR to:
- break any law, regulation, court order or third-party platform rule;
- infringe intellectual property, privacy, confidentiality or other rights;
- upload malware, bypass access controls, probe security, scrape the service at unreasonable scale or interfere with other users;
- impersonate another person, provide fraudulent information or make unauthorised purchases;
- publish spam, deceptive, discriminatory, abusive, exploitative or unlawful content;
- share purchased access, resell the service or copy substantial content except with written permission;
- submit official, confidential, leaked or copyrighted examination materials without authority; or
- use automated output without appropriate human review where it may affect a person’s rights, safety, education or business.
11. User content
You retain ownership of content you lawfully submit or create. You grant ADAR a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt, process and transmit that content only as needed to operate, secure, support and improve the requested service and to perform actions you authorise.
You confirm that you have the rights and permissions needed for the content and any personal data it contains. You are responsible for reviewing content before publishing it externally. You may remove content through available controls, subject to retention needed for backups, security, transactions and law.
12. ADAR intellectual property
ADAR and its licensors own the platform, software, design, trademarks, documentation and ADAR-created content, excluding user content. Subject to these Terms and payment where applicable, we grant you a limited, revocable, non-exclusive, non-transferable right to use the service for its intended personal, educational or internal business purpose.
You may not copy, sell, sublicense, reverse engineer or create competing datasets or services from ADAR except where applicable law expressly permits and cannot be excluded.
13. Third-party services and integrations
ADAR may connect to payment gateways, authentication providers, delivery services, social platforms, messaging services and other third parties. A connection occurs only when configured or authorised by an eligible user or administrator.
Third-party services are governed by their own terms, policies, availability and review requirements. ADAR does not control them and cannot guarantee approval, continued API access, delivery, settlement or publication. You authorise ADAR to exchange the information required to carry out the requested integration action.
14. Privacy
Our collection and use of personal data are described in the ADAR Privacy Policy. Organisation administrators are responsible for providing appropriate notices and obtaining required authority for personal data they enter or direct others to enter into ADAR.
15. Availability, maintenance and changes
We aim to provide a reliable service, but uninterrupted availability is not guaranteed. Maintenance, security work, third-party outages, internet conditions and events outside reasonable control may affect access. We may apply reasonable limits to protect security, performance and fair use.
16. Disclaimers
To the extent permitted by law, ADAR is provided on an “as available” basis. We do not warrant that every feature or output will be uninterrupted, error-free or suitable for every purpose. Nothing in these Terms excludes any guarantee, right or remedy that cannot lawfully be excluded under applicable consumer law.
17. Limitation of liability
To the extent permitted by law, Adar Digital Sdn. Bhd. is not liable for indirect, incidental, special or consequential loss; loss of profits, opportunity, goodwill or data; or loss caused by unauthorised use, third-party services, external platform decisions or reliance on unreviewed automated output.
Where liability cannot be excluded, it is limited to the remedy and amount required by applicable law. Nothing limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that the law does not permit us to limit.
18. Suspension and termination
You may stop using ADAR at any time. We may restrict, suspend or terminate access where reasonably necessary to address non-payment, security risk, unlawful activity, material breach, harm to users or third parties, or discontinuation of a service.
Where appropriate, we will provide notice and an opportunity to remedy the issue. Provisions concerning payment obligations, intellectual property, disclaimers, liability, disputes and records survive termination where their nature requires.
19. Responsibility for misuse
To the extent permitted by law, an organisation using ADAR agrees to indemnify Adar Digital Sdn. Bhd. against third-party claims and reasonable costs arising from that organisation’s unlawful content, unauthorised data processing, infringement of rights or material breach of these Terms. This section does not apply to the extent a claim results from ADAR’s own breach or wrongdoing.
20. Changes to these Terms
We may update these Terms to reflect service, business or legal changes. The revised version will be published here with a new “Last updated” date. Material changes will receive additional notice where required. Continued use after the effective date means you accept the revised Terms, unless applicable law requires another form of consent.
21. Governing law and disputes
These Terms are governed by the laws of Malaysia. Courts with jurisdiction in Malaysia have jurisdiction over disputes, subject to any mandatory consumer right or dispute forum that applies. Before filing a claim, please contact us so the parties can attempt to resolve the issue in good faith.
22. General terms
If a provision is unenforceable, it will be limited or removed only to the minimum extent necessary and the remaining provisions continue. A failure to enforce a provision is not a waiver. You may not assign your rights without our written consent; we may assign these Terms as part of a reorganisation or transfer of the service, subject to applicable law. These Terms, the Privacy Policy and any product-specific terms shown before purchase form the agreement for the relevant service.
